In Turkey, the Constitution and the Turkish Penal Code form the fundamental basis of criminal law. The Constitution states that everyone has the right to a fair trial and punishment by the justice system in the event of committing a crime. The Turkish Penal Code determines the penalties for crimes committed in Turkey.

The Turkish Penal Code prescribes different penalties according to the types and severity of crimes. The measure of punishment is determined based on the nature, characteristics, impact on the victim, society, and potential harm to the state caused by the crime. The law also provides for alternative penalties, such as fines or imprisonment, depending on the commission of the offense.

The Code of Criminal Procedure regulates the trial process and enforcement of penalties for individuals who commit crimes. It contains important provisions to ensure a fair trial process. According to the Code of Criminal Procedure, individuals who commit crimes have the right to retain an attorney, and their defense rights are protected during the stage of gathering and presenting evidence. Additionally, matters such as the appeal of court decisions and the organization of enforcement are regulated by the Code of Criminal Procedure.

In Turkey, criminal law is continuously developed and updated to maintain a delicate balance between the protection of human rights and the punishment of crimes. High courts such as the Court of Cassation and the Council of State render significant decisions in criminal law, contributing to its development. As a result, criminal law in Turkey emerges as a constantly evolving field based on fundamental laws and judicial decisions.
