Arbitration is an alternative dispute resolution method used to resolve disputes between parties. In this method, the parties bring their disputes before one or more arbitration arbitrators, and the decisions rendered by the arbitrators are final.

Arbitration law in Turkey is regulated by the International Arbitration Law adopted in 2001 and its implementing regulations. The International Arbitration Law ensures that arbitration proceedings in Turkey are conducted in accordance with international standards. Additionally, international agreements and treaties that Turkey has signed also affect arbitration law.

In Turkey, arbitration is generally conducted based on arbitration clauses included in contracts. If there is no arbitration clause in the parties’ agreement, it is necessary to file a lawsuit before resorting to arbitration. However, it is possible for the parties to reach an agreement on arbitration and enter into an arbitration agreement before deciding to file a lawsuit.

Arbitration proceedings in Turkey are divided into domestic arbitrations and international arbitrations. Domestic arbitrations take place when both parties are domiciled in Turkey. International arbitrations, on the other hand, are conducted when the parties are from different countries or when the dispute has an international nature.

Arbitration proceedings in Turkey are mainly conducted by the Istanbul Chamber of Commerce Arbitration Center or Istanbul Bilgi University Arbitration Center. Parties may also choose different arbitration centers outside of these institutions. The number of arbitrators in arbitration proceedings is determined according to the parties’ agreement. Generally, three arbitrators are appointed in Turkey, and they render decisions on the parties’ dispute. The appointment and removal of arbitrators are regulated by the International Arbitration Law and its implementing regulations.
