Citizenship and Foreigners Law

Citizenship Law in Turkey is determined by the Constitution of the Republic of Turkey, the Turkish Citizenship Law, and relevant regulations. According to the Turkish Citizenship Law, Turkish citizens include those who are Turkish citizens by birth, those born to Turkish citizen parents, those who become Turkish citizens through adoption, those who acquire Turkish citizenship by birthplace or by citizenship-related circumstances, and those who become Turkish citizens through special laws.

The legal status of foreigners in Turkey is regulated by the Law on Foreigners and International Protection and relevant regulations. According to this law, foreigners who wish to enter Turkey are required to obtain a visa. Additionally, foreigners who intend to reside in Turkey must obtain the necessary permits. The permits granted to foreigners in Turkey may vary in types such as short-term residence permit, long-term residence permit, work permit, student permit, family reunification permit, and others.

It is possible for foreigners to apply for citizenship. These applications are determined by the Turkish Citizenship Law and relevant regulations. Foreigners who wish to apply for Turkish citizenship must meet certain conditions. These conditions may include acquiring citizenship through naturalization, acquiring citizenship through marriage, acquiring citizenship through investment, and other different ways.

As a continuation of Citizenship and Foreigners Law, migration law is also an important issue in Turkey. Migration law is the branch of law that regulates migration movements between countries, i.e., the movement of people from one country to another. Turkey, due to its geographical location, is an important country in terms of migration law as it serves as a transit route or destination for migrants.

Migration law in Turkey encompasses regulations regarding the entry, residence, and employment of foreigners in Turkey. These regulations cover a wide range of activities, from foreigners traveling to Turkey for tourist purposes to foreigners obtaining work permits and working in Turkey. These regulations are implemented by various institutions, primarily the Directorate General of Migration Management under the Ministry of Interior.

Another important aspect of Foreigners Law in Turkey is the application process for work permits for foreigners. In order for foreigners to obtain work permits in Turkey, they first need to receive a job offer. Employers are required to submit their job offers to the Directorate General of Migration Management for foreigners to be able to obtain work permits. Applicants can obtain work permits after fulfilling certain conditions and submitting the necessary documents.

The property rights of foreigners in Turkey are also protected. However, there are certain restrictions on foreigners’ acquisition of immovable property in Turkey. Accordingly, foreigners can only acquire immovable property in Turkey if they meet specific requirements. The legal regulations determining whether foreigners are entitled to acquire real estate in Turkey play a significant role in this regard.

Citizenship and Foreigners Law in Turkey is a legal field that regulates the relations between foreigners residing in Turkey and Turkish citizens, aiming to facilitate their presence and business activities in Turkey. In this field, issues such as the rights and protection of foreigners, procedures, and foreigners’ acquisition of immovable property in Turkey are of great importance. Legal remedies are available for the resolution of disputes related to citizenship and foreigners law in Turkey, including administrative courts, tax courts, Civil Courts of First Instance, and Administrative Courts.
